Terms and Conditions

Ownership and Originality

The Author warrants and guarantees that they shall maintain full ownership of all the rights and licenses, including all creative elements that are compiled within the “material” denominated as the book cover design, book interior design, layout, illustrations, and book content.

The Author, in good faith, upholds, certifies, and guarantees that they solely own the manuscript and the copyright of its contents and appendices in the subject “material.” The Author shall ensure that the “material” shall not infringe any Intellectual Property Rights (IPR) owned by third parties. Should there arise a case and/or dispute concerning Intellectual Property Rights (IPR) in the contents and images found in the “material,” the Author shall undertake and endeavor to protect 20/20 Literary Group in order for the latter not to be held liable, whether civilly or criminally, etc., by the owner of the infringed Intellectual Property Rights (IPR) and ALL the expenses in relation thereto shall be shouldered by the Author. Should the “material” be ultimately adjudged to have infringed any Intellectual Property Rights (IPR) owned by third parties after 20/20 Literary Group commenced its marketing, the Author is obliged to fully pay 20/20 Literary Group the total amount of the agreed marketing fee herein plus damages in an amount equivalent thereto.

Marketing Fee and Mode of Payment

The aforesaid marketing fee shall be paid upon execution of this agreement. Should the Author make a payment in any currency other than USD, the Author shall pay any difference between the conversion of the amount paid as converted into USD at the prevailing conversion rate (“USD Equivalent”) compared to the USD Purchase Price (“Shortfall”). Should the mode of payment be made through a supplied credit or debit card, the Author expressly authorizes 20/20 Literary Group to charge the supplied credit or debit card in the amount of the agreed marketing fee.

The Author hereby represents that they have the full right and authority to authorize 20/20 Literary Group to utilize the payment information supplied herein. Hence, the author agrees to indemnify and hold 20/20 Literary Group harmless for any claims arising from its use of the payment information that the Author supplied for purposes of the payment of the marketing fee. In the event that the Author rescinds the aforesaid authorization, such shall only be binding and honored by 20/20 Literary Group if communicated in writing—provided further that the payable amount shall be paid prior to the effectivity of the rescission. 20/20 Literary Group shall not be responsible for any fees that the Author may incur due to insufficient funds at the time the payment is processed through the payment information supplied by the Author.

Mode of Marketing

The Author has chosen and elected 20/20 Literary Group shall promote, market, sell and distribute the book entitled “BOOK TITLE” through SERVICE NAME. 20/20 Literary Group shall collaborate with a massive network of distributors, vendors, and marketers and employ the most effective, industry-approved marketing formulas and strategies to amplify a book’s selling angles.

However, 20/20 Literary Group does not guarantee a specific amount of book sales or sales of the subject “material.” 20/20 Literary Group makes no warranties or promises as to the minimum success of the services or the sum of book sales from the above-mentioned mode of marketing. Should the Author opt and intend to avail of any other marketing services not covered and embraced in the mode of marketing elected herein or change the mode of marketing herein indicated, the same shall be subject to another fee.

Commencement of Marketing Services

20/20 Literary Group shall immediately commence the marketing of the book entitled “BOOK TITLE” upon full payment of the above-mentioned marketing fee, and the subject “material” is already submitted to 20/20 Literary Group, which is ready to market.

Obtainability and Distribution

Books are accessible to consumers in the format (e-book, softcover, hardback) elected by the Author as part of his package. They will be available for as long as the Author wants to keep them in print. In the event as the Author wishes to print their book for personal retail, Author Volume Discounts will be afforded among his printing options.

Invalidation

In the event of invalidation of any one of the terms, conditions, restrictions, or other provisions contained herein by judgment or court order shall in no way affect any of the other terms, conditions, restrictions, or provisions, hereof and the same remain in full force and effect.

Venue

Should litigation arise from this agreement, the parties herein have agreed that the venue thereof shall belong exclusively to the proper courts of Las Vegas, Nevada, USA, to the exclusion of all others.

Non-waiver

The failure of 20/20 Literary Group to insist upon strict performance of any of the terms, conditions, and covenants hereof shall not deem a relinquishment or waiver of the rights or remedy that it may have, nor shall it be construed as a waiver of any subsequent breach or default of the terms, conditions, and covenants shall continue to be in full force and effect.

No waiver by 20/20 Literary Group or any of its rights under this agreement shall be deemed to have been made unless expressed in writing and signed by the proprietor of 20/20 Literary Group.
